Brazil🇧🇷: new Finance Ministry resolution clarifies methods for combating illegal online gambling and betting

On September 14, Resolution SPA/MF No. 2750 was published, repealing the previous SPA/MF No. 566 of March 20, 2025 on the same subject.

➡️ The resolution provides for the practical implementation of Decree No. 13,033 of June 19, 2026, which introduced "financial asphyxiation" mechanisms, and establishes the joint and several tax liability introduced by Complementary Law No. 224 of December 26, 2025. These two documents created the legal framework, while the new resolution establishes procedures for financial institutions.

➡️ Banks and payment systems are required to monitor signs of improper use, including:

🟢 recurring amounts within a range similar to amounts typically associated with betting;

🟢 high frequency of transfers involving small amounts from different senders;

🟢 the presence in #Pix transaction descriptions of terms such as "betting", "bonus", "top-up", "predictions", "prizes", or the names of operator brands;

🟢 frequent changes to Pix keys, QR codes or recipient accounts shortly after blocks or the termination of business relationships.

🟢 transactions involving legal entities registered at virtual offices, coworking spaces or residential addresses;

🟢 large transaction volumes involving recently created CNPJ numbers (the Brazilian equivalent of a tax identification number) that are inconsistent with the declared business activity.

🟢 The resolution also introduces the concept of an intermediary: any individual or legal entity that repeatedly moves funds on behalf of a non-compliant operator.

🟢 The analysis period may not exceed 45 days from the identification of a suspicious situation.

➡️ How does the operational process work?

🟢 The regulator (SPA-MF) identifies violations and prepares a report.

🟢 SPA-MF notifies financial institutions and the Central Bank of the identified violations.

🟢 The offenders' accounts are blocked within 24 hours.

🟢 Confirmation of the block is sent to the SPA within 48 hours.

🟢 The documents are forwarded to the National Secretariat of Public Security for confiscation proceedings.

🟢 A blocking notice may be accompanied by a joint and several tax liability notice. This means that institutions processing illegal transactions may be jointly and severally liable for the payment of taxes.
