💥Chile 🇨🇱: online gambling declared illegal by Supreme Court — what is not authorized is prohibited

The Supreme Court upheld the appeal filed by the Lotería de Concepción against telecom companies Claro, Entel, GTD, Telefónica, WOM, and VTR. As a result, they are now required to block gambling websites nationwide.

▶️Background: in Chile, only the Polla Chilena de Beneficencia, land-based casinos, horse racing at racetracks, and the Lotería de Concepción are authorized and regulated. Meanwhile, the bill to regulate online gambling has been stalled in the Senate for over 18 months, mainly due to lack of agreement on taxation. As a result, unregulated operators have no legal foundation.

▶️Prior situation: in July 2024, the Lotería de Concepción requested that internet providers block all online betting platforms, including well-known brands such as Betano, Coolbet, JugaBet, Rojabet, Betsson, among others. The Polla Chilena de Beneficencia supported this demand.

▶️Court ruling: the court determined that the companies’ actions infringed upon the constitutional rights of the state lottery. This sets a legal precedent that, until regulation is enacted, may be used against gambling industry operators in various contexts, both within and outside Chile.

▶️Context: according to the Gambling Superintendency, more than 900 websites operate in the country, generating a market valued at over USD 150 million annually.
