🐒 Brazil🇧🇷: the total gambling ban has failed, and lawmakers are preparing to backtrack
The so-called “Provisional Measure No. 1394/2026” has already received 97 amendments, and Congress is working on alternatives.
➡️ The focus is now on the fact that the ban is indeed temporary. However, there is still no clarity on the timeline.
➡️ Specifically, there is a proposal to permanently ban the illegal market.
➡️ The amendments were submitted by 24 lawmakers (18 members of the lower house and 6 senators). Their authors later withdrew 5 amendments, while 92 remain under consideration by the joint committee. Notably, 38 of the 97 amendments were submitted on October 13, the final day for filing.
➡️ The proposals fall into five main areas:
🟰 Advertising: restricting advertisements to the brand name alone;
🟰 Responsible design: introducing requirements for the design of online games;
🟰 Player spending controls: requiring the identification of players whose spending does not correspond to their income. Supporters of the ban argued that people were using government benefits to fund their betting activities. Among the measures under consideration is a proposal to provide banks with an official register of accounts and #Pix keys subject to blocking.
🟰 Technology providers: making registration mandatory;
🟰 Illegal advertising: requiring the removal of illegal advertisements within 48 hours.
➡️ The inspection fee will be allocated entirely to oversight of the sector.
➡️ Another option under consideration is to ban online casinos while allowing sports betting to continue.
➡️ As for betting, one proposal would prohibit gambling and deposits between 10 p.m. and 5 a.m.
➡️ For sports clubs, the main proposal is amendment No. 11, submitted by center-left lawmaker Marcos Braz. It would allow brands of authorized sponsors to remain on club jerseys and stadiums until the end of the season, for a maximum of 24 months.
➡️ The joint committee tasked with examining these issues was appointed on September 30, but has yet to be formally established. The provisional measure will block consideration of Congress’s legislative agenda starting November 9. However, it is set to expire on November 23, although it can be extended for an additional 60 days. The parliamentary recess suspends the countdown. As a result, it could take three to four months for the situation to become clearer. However, the political landscape will also play a decisive role, with further developments now expected to depend on the second round of the presidential election scheduled for October 25.
