🆘 Poland🇵🇱: the Office of Competition and Consumer Protection (UOKiK)steps up scrutiny of betting operators
The Office of Competition and Consumer Protection (UOKiK) has launched a new round of regulatory scrutiny focused on identifying so-called “dark patterns” — design and communication techniques that may influence or manipulate consumers’ decisions. The review will cover contractual terms, website design, and other potentially manipulative practices.
⬇️ The checks are expected to cover major players in Poland’s betting market, including STS, Fortuna Online Zaklady Bukmacherskie, Superbet Zaklady Bukmacherskie and Bukmacherska, identified by UOKiK through the brands Fuksiarz.pl, E-toto Zaklady Bukmacherskie, LV Bet Zaklady Bukmacherskie and Totalbet Zaklady Bukmacherskie.
⬇️ The Office said that AI technologies will be used to help identify potential manipulation practices and other forms of problematic website design.
⬇️ UOKiK stressed that the initiative is being conducted as part of its “monitoring” and “educational” activities and does not, at this stage, constitute a finding that the companies have violated the law.
⬇️ However, there is an important qualification❗️ The use of prohibited contractual clauses and certain other violations may result in financial penalties of up to 10% of turnover.
