😳 Peru🇵🇪: the regulator tightens anti-money laundering controls for land-based and online gambling venues

The Superintendency of Banking, Insurance and Private Pension Funds (SBS) has officially approved a new regulatory framework aimed at strengthening anti-money laundering and counter-terrorism financing controls in the gambling sector.

➡️ Resolution SBS No. 1695-2016 will be replaced by Resolution No. 01015-2026, under which:

➡️ Operators must implement an Anti-Money Laundering and Counter-Terrorism Financing (AML/CFT) system, tailored to the specific risk profile of their operations.

➡️ Employees and senior management are required to undergo mandatory annual training on the prevention and detection of financial crimes, with proper documentation of completion.

➡️ Companies must establish policies for the identification and verification of customers, ultimate beneficial owners (UBOs), executives, and suppliers.

➡️ Both online platforms and land-based casinos must conduct ongoing monitoring of higher-risk customers, including politically exposed persons (PEPs) and individuals previously linked to financial crimes.

☠️ Companies must keep an Operations Register, recording significant transactions such as chip exchanges and prize payouts, especially when amounts exceed 2,500 USD or the equivalent in local currency. These records must be stored for at least 5 years and provided upon request to both Peru’s Financial Intelligence Unit (UIF) and the supervisory authority.

☠️☠️ Suspicious transaction reports to UIF-Peru will be mandatory and must be filed within a maximum of 24 hoursfrom detection.

☠️☠️☠️ Under the sanctions regime, violations are classified as minor, serious, and very serious, with fines of up to 8 Tax Units (UITs) (approximately USD 13,000). The most severe breaches include failure to report suspicious transactions, failure to screen against UN Security Council sanctions lists, and failure to comply with asset-freezing orders issued by UIF-Peru.
