The restrictions could affect customers who make frequent transfers or receive money from third parties without a clear or formal justification. According to BCP, such transactions are not consistent with the intended use of savings accounts, which are designed exclusively for personal or family expenses.

➡️ Context: Banco de Crédito del Perú is the country’s largest private banking institution. It was founded in 1889 by a group of Italian-Peruvian entrepreneurs and is part of the financial conglomerate Credicorp. Its total assets amount to approximately USD 39 billion, with a market share of 30.4% in loans and 33.5% in deposits.

➡️ Scope of the measure: the bank stated that the restriction is not limited to lotteries or accounts linked to gambling, but also applies to:

⛔️ charitable fundraisers (for example, small auctions organized by school committees)

⛔️ donations related to political campaigns

⛔️ recurring transfers to informal organizations or periodic payments without contractual backing. In these cases, the bank may interpret that the account is being used for commercial purposes and proceed with its closure.

➡️ Legal aspects: in case of disputes, the bank may invoke Article 1430 of the Civil Code, which allows termination of the banking contract in previously established situations, provided that the client is notified in advance.

➡️ The closure of accounts may also apply when digital wallets (for example, #Yape) are used for commercial activities, raffles, or lotteries, as this would constitute a contractual breach.

➡️ The bank clarified that the measures apply only to savings accounts. For activities such as fundraising or raffles, other financial products may be more appropriate.
