🦙 Peru🇵🇪: regulatory reform of gambling and betting submitted for public consultation
If the amendments are approved, the minimum fine will be reduced, while advertising rules will become stricter.
🎯 Peru’s Ministry of Foreign Trade and Tourism (MINCETUR) has launched a public consultation on proposed amendments to Law No. 31557, which regulates gambling and betting. The draft was published on October 21, 2026, and the deadline for submitting proposals is 15 calendar days.
🎯 The proposed fines would be reduced:
🔴 For very serious violations, from 200 to 70 tax units (UIT).
🔴 For serious violations, from 150 to 35 UIT.
🔴 For minor violations, from 50 to 11 UIT.
In 2026, 1 UIT = 5,500 soles (approximately USD 1,600).
🎯 The bill also establishes criteria for determining the severity of violations: unlawful gains, damage caused, intent, impact on the market and consumers, history of violations, and the offender’s financial situation. In addition, fines must not exceed 10% of the operator’s gross revenue for the year preceding the violation, except in cases of repeat offenses or operating an unlicensed platform. If the offender fails to provide evidence that their income was lawfully obtained, MINCETUR may impose the maximum penalty.
🎯 Voluntary acknowledgment of violations would also qualify for reduced fines. The discount would be 50% if the violation is acknowledged before the investigation report is prepared, 35% if it is acknowledged before the sanctions decision is issued, and 25% if the fine is paid without filing an appeal. However, these reductions would not apply to repeat offenders.
🎯 Advertising and intermediary rules will become stricter.
🔴 Only platforms and products licensed by MINCETUR may be promoted, and advertisements must indicate the license number and license holder.
🔴 Advertising must not target minors, portray gambling as a solution to financial problems or a source of income, or associate it with prestige, success, or attractiveness.
🔴 Warnings about the risk of gambling addiction must be displayed for at least 5 seconds or occupy at least 10% of the total advertising area, depending on the format.
🔴 The operator will be held responsible for advertising violations committed by influencers.
🎯 The proposal also seeks to revise several technical requirements, including removing the obligation to provide usernames and passwords, shortening password length, and extending the reauthentication period from 30 days to 6 months. MINCETUR will be able to request information on deposits, withdrawals, prizes, bonuses, fees, events, markets, player accounts, and providers. The proposal also provides for the confiscation of assets linked to illegal operations.
🟥 Context: Peru has one of the region’s simplest licensing procedures. The country has 92 legal operators. In the first half of 2026, the industry generated more than USD 91 million in revenue.
