😳Peru🇵🇪: Gambling industry pressures regulator, demands multimillion-dollar tax refunds

One year ago, the government enacted Legislative Decree No. 1,644, extending the selective consumption tax (ISC) to online casino and sports betting operators. While the measure was initially welcomed, the regulator has now decided to review and amend the regulation.

▶️At present, Congress is debating a new bill intended to address several shortcomings in how the ISC is applied to online gambling and betting.

▶️The main objective is to prevent betting operators from turning to ordinary courts or the Constitutional Courtto challenge tax collections, although the elimination of tax benefits is not explicitly part of the proposal.

▶️Experts warn that operators could file lawsuits to claim back previously paid taxes, which would threaten the stability of the regulatory framework. Furthermore, remaining within the official licensing system could become unattractive.

▶️If the courts rule in favor of the companies, the Peruvian State would be forced to refund millions of soles already collected under the ISC, resulting in a significant loss for public finances.
