⚠️ Germany 🇩🇪: Federal court limits IP blocking in the gambling sector

Article 9 of the 2021 "State Treaty on Gambling" (GlüStV 2021) can no longer be used to force internet providers to block betting sites, even if they operate illegally.

▶️ The court ruled that, according to the liability criteria set in the former Telemediengesetz, internet providers are technical intermediaries with no control over content, meaning they are not obligated to enforce blocks.

▶️ The regulator, the GGL (Joint Gambling Authority of the Federal States), must comply with the ruling.

▶️ However, the decision does not affect hosting-level blocking measures, which remain in place. To date, the regulator has blocked more than 930 domains in Germany, adding around 60 new blocks per month. When domains reappear under different providers, the process restarts.
