🎉 Colombia🇨🇴: the Constitutional Court suspended the decree introducing VAT on the gambling sector

The ruling concerns Decree No. 1390 of 2025, through which the government of President Gustavo Petro declared a “state of economic and social emergency across the national territory”. The decree was intended to address projected budget shortfalls for 2026 and included measures affecting the gambling industry.

🔣 As a direct consequence of the judicial suspension, Decree No. 1474 has also been rendered ineffective. This measure provided for the introduction of a 19% value-added tax (VAT) on gross gaming revenue (GGR), applicable to both domestic and foreign operators.

🔣 Under this ruling, the tax may not be collected, at least until the full bench of the Court issues a final decision on the constitutionality of the decree. Funds already collected remain unchanged for the time being.

🔣 Following the ruling, President Gustavo Petro publicly expressed his disagreement, stating that the Court’s position benefits high-income groups, described the suspension as a “financial setback,” and reiterated his stance in favor of greater social justice.
