⛔️ Chile🇨🇱: the court of appeals established the permanent blocking of online casinos

The proceedings originated from a constitutional protection action filed by the state lottery Lotería Concepción against the main telecommunications companies Claro, Entel, GTD, Telefónica, WOM, and VTR. The lottery sought to have these Internet service providers completely block online gambling platforms that do not have a clearly defined legal status in the country.

For a year, the plaintiffs continued to pursue their request, and ultimately obtained a favorable ruling.

🔴 The Telecommunications Subsecretariat (Subtel) will now prepare a list of prohibited operators for Internet service providers, which will be used to conduct permanent checks for mirror websites.

🔴 After comparing DNS, SNI, and DPI, representatives of the Telecommunications Subsecretariat (Subtel) determined that the latter two blocking methods are highly invasive and pose significant risks to privacy, data protection, and cybersecurity. Therefore, they will begin with DNS blocking.

🔴 The state entities Polla Chilena de Beneficencia and Lotería Concepción will directly report suspicious URLs to the Superintendency of Casinos.

🔴 Representatives of the Chilean Online Betting Platforms Association (aPAL), which includes Latamwin, Juegaenlinea, Betsson, and Coolbet, continue to argue that these measures contradict the “principle of net neutrality” and violate the right to data protection.
