🆘 Chile🇨🇱: senators propose prison sentences of up to 15 years for illegal gambling operators

Senator Paulina Núñez, a prominent figure on the Senate’s right wing, introduced this amendment to the pending bill. Its stated aim is “to prevent the expansion of the illegal market, protect families, and shut down digital spaces that may be used by organized crime.”

▶️ The proposal provides for:

🔵 Prison sentences of up to 15 years in certain cases involving aggravating circumstances, such as the use of false identity documents or fictitious corporate structures to conceal business owners.

🔵 Fines of up to 10,000 UTM (monthly tax units).

🔵 Criminal liability for legal entities involved in these activities.

▶️ The amendment also proposes establishing a judicial procedure to enable the permanent blocking of websites, applications, and channels used to offer illegal betting. Dynamic mechanisms would also be introduced to extend restrictions to new platforms created solely to circumvent the original bans.

▶️ Unlike a model that allows private operators to obtain licenses, Núñez proposes reserving the digital operation of authorized games exclusively for the state lotteries “Polla Chilena de Beneficencia” and “Lotería de Concepción,” which are authorized under the relevant laws.

🔫 Payment service providers are also in the spotlight: the proposal includes restrictions and criminal liability for those who knowingly finance or commercially promote illegal platforms while aware that they operate unlawfully.
