🎰 Chile🇨🇱: government finally submits a bill to regulate gambling

Just over a year has passed since all gambling activities in the country were declared illegal.

➡️ What does the Government propose❓

🔄 Platforms will have to apply for a license valid for 5 years. The annual licensing fee will amount to 1,000 UTM (monthly tax units; in October 2026, 1 UTM is equivalent to approximately USD 73).
🔄 Licensed operators will be required to pay 19% VAT monthly on the difference between the total amount wagered and the winnings paid out, plus an additional 3% levy.

🎯 A “cooling-off period” will also be introduced: license applications will be rejected if the operator or any of its affiliates conducted business, advertised, or offered services in the country without authorization during the 12 months preceding the application. Grounds for rejection will include using a .cl domain, entering into sponsorship agreements, or working with Chilean payment providers.

🎯 HOWEVER❗️ Companies will be able to bypass this period by opting for a “transitional regime”. To qualify, they must pay a “licensing authorization fee” of 3,000 UTM and have no outstanding digital VAT liabilities. Furthermore, companies that carried out transactions subject to digital VAT before the law takes effect will have to settle the corresponding tax liabilities for the 36 months preceding the filing of their tax returns.

➡️ Advertising and bonuses

🔄 In short: online betting advertising will be completely prohibited for advertisers, developers, distributors, intermediaries, and influencers. No exceptions, apparently.
🔄 (HOWEVER❗️ Another “transitional regime” will apply: existing advertising contracts may remain in force for one year, except during time slots designated for children's programming).
🔄 Bonuses, incentives, and rewards will also be prohibited, “even if no advertising promoting them is distributed”.

➡️ Customer protection

🔄 All gaming accounts will have to incorporate safer gambling features, including deposit limits and restrictions on session duration.
🔄 Authentication: the system will rely on biometric verification, a self-exclusion register, and lists of individuals serving prison sentences and those seriously delinquent on child support payments. In addition, athletes, sports officials, and shareholders of clubs participating in a particular sport will be prohibited from betting on that sport.
🔄 A fund for the prevention and treatment of gambling addiction will be established under the supervision of the Ministry of Health.
🔄 The Ministry of Finance will develop Responsible Gambling Regulations, which will be reviewed every 4 years.

✏️ Context: a week ago, Senator Paulina Núñez submitted a package of amendments to the proposed bill containing considerably more restrictive measures: from prison sentences of up to 15 years for serious violations to maintaining the regulatory monopoly of Polla Chilena, rather than opening the market to private operators through a licensing system.
