💣 Brazil🇧🇷: São Paulo court allows online casino Stake to resume operations until October 25

💣 Brazil🇧🇷: São Paulo court allows online casino Stake to resume operations until October 25

The decision follows the company's legal challenge to the ban, which brought an end to the country's legal framework for regulating the betting sector. Stake filed a lawsuit seeking two main forms of relief:

1) Suspend the application of the controversial Provisional Measure 1,394/2026, issued by President Luiz Inácio Lula da Silva on September 25.

2) Allow the company to continue operating until December 31, 2029.

➡️ The presidential decree remains in force, but Stake has been authorized to resume providing its services until October 25, 2026. The ruling contains ambiguous wording, stating that the company may operate “until October 25 or until a further court decision is issued, whichever comes first.” The precise scope of this authorization remains subject to judicial clarification.

➡️ The federal judge's decision also suspends the blocking of the platform, allowing Stake to resume operations during the authorized period.

➡️ The resumption of operations is subject to compliance with 12 conditions:

🟡 Maintaining identification mechanisms for players placing bets.
🟡 Preventing individuals barred from betting under the law, government programs, or regulatory mechanisms from participating.
🟡 Prohibiting bets funded with money received through social welfare programs.
🟡 Prohibiting advertising directed at children and teenagers.
🟡 Refraining from launching new advertising campaigns or initiatives aimed at expanding the user base.
🟡 Ensuring that players can withdraw their balances.
🟡 Maintaining sufficient funds to cover outstanding balances.
🟡 Retaining registration, financial, and transaction records.
🟡 Ensuring that reports required by regulatory authorities are submitted.
🟡 Prohibiting operations through unauthorized domains.
🟡 Preventing the court ruling from being used to “legalize the activities of illegal operators or third parties abusing the Stake brand.”
🟡 Maintaining measures to combat fraud, counterfeiting, trademark misuse, and the activities of unauthorized operators.

➡️ Stake is not the only industry participant to have filed a lawsuit challenging Provisional Measure 1,394/2026. In addition to representatives of the betting sector, the Brazilian Association of Radio and Television Broadcasters and several sports clubs that lost sources of funding have also taken legal action.

➡️ The case is also unfolding against the backdrop of the ongoing presidential election. According to some analysts, the controversial ban cost Lula da Silva votes he needed to secure a first-round victory.
