📝 Brazil🇧🇷: new rules for disputing Pix transfers

In short: the amendments concern fraudulent transactions, while most of the existing rules remain unchanged.

🟩 What has changed❓

💬 Users can now upload photos of documents, such as police reports or screenshots, directly through their banking apps.

💬 It is now prohibited to include advertisements or hyperlinks on payment receipts, helping to reduce the risk of fraud.

💬 Banks must notify payers of changes to their saved contact details.

💬 The “Payment purpose” field must be clearly displayed next to the recipient’s name to help prevent errors.

💬 The definition of a fraudulent transaction has been clarified: transfers made by mistake, as well as losses resulting from betting, lotteries or gambling, cannot be disputed through this mechanism. Banks must inform users about the available channels for filing complaints.

🟩 And which ones can be disputed❓ The changes concern the special fund-return mechanism (Mecanismo Especial de Devolução, or MED), created by the Central Bank to compensate losses resulting from fraud. Banks must implement the new rules by March 1, 2027.

🟩 The main MED rules remain in force. Banks have 11 days to review a request and return the funds, provided there is a sufficient balance in the recipient's account. Users, however, now have 80 days instead of 30 from the transaction date to file a claim.

📝 How does the dispute process work❓

🟢 The user clicks the “Dispute Pix” button in the app, selects the relevant transaction from the list and specifies the reason for the claim.

🟢 Available reasons: fraud, deception and threat or coercion.

🟢 The user may optionally upload supporting documents.

🟢 The bank generates a case record indicating the date and time of the request and informs the user of the response deadline.

🟢 The bank launches an investigation and determines whether a request to recover the funds should be submitted through the Transaction Account Identifier Catalog.

🟢 If there are indications of abusive litigation, the bank may reject the claim.

🟢 Accounts suspected of fraudulent activity may be blocked for up to 11 days.

🟢 The affected user may withdraw the request at any time.

🟩 Context: as a reminder, Russian citizens can now also pay for purchases in Brazil using Pix QR codes through integration with the “My MTS” app. These rules are worth keeping in mind.
