Senator Anabel Fernández Sagasti proposed reconsidering the bill S-1300/24, aimed at creating a regulatory framework for online gambling and betting.
🎯 What does the bill propose❓
🔹 A complete ban on advertising for gambling and betting in the media, on social networks, and in campaigns involving celebrities and influencers.
🔹 Warnings about the risks of gambling addiction on authorized platforms. Biometric verification would also be required to prevent access by people under the age of 18.
🔹 Payments would be permitted only through debit cards and digital wallets. All credit products and social cards would be excluded.
🔹 Deposit limits.
🔹 Time limits on gambling: once the maximum session time is reached, the session would automatically end, and play could not resume until 10 hours had passed.
🎯 What penalties would operators face for violations❓
⬆️ Fines ranging from 3,000 to 5,000 UVA units, with higher fines in cases of repeat violations.
⬆️ Temporary blocking or license revocation.
⬆️ A prison sentence of 1 to 4 years for providing credentials that enable minors to participate.
⬆️ If a legal entity is blocked, its partners, members and management could assume joint and several liability. The proposal would allocate the proceeds from fines to gambling-addiction prevention and treatment, including prevention and awareness programs.
🎯 What other measures are included❓
🟠 Creation of a national register of operator licenses.
🟠 Agreements with companies, public authorities and nonprofit organizations for the identification, blocking and removal of content related to illegal gambling.
🟠 Blocking online access to betting in schools, public spaces and through free Wi-Fi networks.
🟠 Implementation of parental-control tools.
🟠 Creation of a national self-exclusion program (ReNA).
The proposal establishes a broad framework covering advertising, access, payment methods, protection of minors and gambling-addiction prevention. The regulatory context, however, remains complex.
🎯 Context: the bill was approved by Congress at the end of 2024. However, in May 2026, the government submitted its own proposal, which takes a considerably more flexible approach. The government bill would prohibit only advertising by unauthorized operators and contains no restrictions on payment methods. As a result, the two proposals remain in conflict, and the legislative process could be prolonged.
